Ending a Lease Calculator

Two rules trip people up. Your termination date must be the last day of a rental period, not simply sixty days after you hand in the letter. And your rental period is anchored to the day your tenancy began.

If a one-year term has already run its course, the tenancy is month to month now and this works that out for you.
Add the date your lease started. Everything here is worked out from it, because your rental period is anchored to that day rather than to the end of the month.
The day you take possession, not the day you want to be out. Your tenancy needs to end the day before.

Notice periods are one of the easiest things to get wrong by a couple of days, and it costs a full month's rent. Happy to check yours.

The rules behind it

  • Month-to-month: 60 days' notice, ending on the last day of a rental period. Your rental period is anchored to the day your tenancy began. A lease that started on the 15th runs the 15th to the 14th, so notice has to terminate on the 14th, not month-end.
  • A fixed term: 60 days' notice, ending on the last day of the term. You generally cannot end one early on your own. Once it expires the tenancy continues month to month by itself, and no new lease is needed for that to happen.
  • Weekly or daily: 28 days' notice, ending on the last day of a rental period. Rare enough that the calculator above does not cover it. If that is you, call me and we will work it out together.
  • Notice goes on Form N9, from the Landlord and Tenant Board. A text message isn't notice. Download the N9 Form →
  • If you post it, allow five days for deemed delivery.
Verify before you rely on it

This implements the rules as I understand them, and a notice deadline is a legal one. Form N9's own instructions from the Landlord and Tenant Board are the final word. Check them before you serve.
